France is violating freedom to provide services: expert

According to Dr. Marek Benio from the European Labor Mobility Institute, France is violating the freedom to provide services with persistent inspections through attempts to prove that Polish entrepreneurs are engaged in illegal economic activities and forcing Polish companies to re-register their activities so that they pay taxes in France.

In an interview with Polish Radio, Mr Benio emphasised that the freedom to provide services allows a service provider established in one country to provide his services to customers who are in another Member State without the need to establish the company in a given country.

“France violates this part of freedom with its inspections by forcing almost every entrepreneur who tries to provide services and delegate workers to the country to set up branches there. It is not so much an attempt to push Polish companies or service providers out of the French market, as it’s rather an attempt to take over these companies and get them to pay social security contributions and taxes in France,” Mr Benio said, stressing that “the services of these companies in France are very much needed by the French economy.”

The issue of persistent inspections was raised during a meeting of the European Parliament’s petitions committee last week. The complaint was filed by Wojciech Rzepka from the ATERIMA company. MEPs demanded explanations from France and asked the European Commission to deal with the issue in order to solve the problem.
